RECKONING: NO IMPUNITY FOR VIOLATION OF HUMAN RIGHTS LAWS

DID YOU KNOW that under International Humanitarian Law we are all obligated to Prevent and Punish the heinous crime of Genocide? Yet, bombs and weapons are built in California and arms are being sent to Israel right out of our Oakland Airport.  Silicon Valley Tech companies are supplying the surveillance and weapon guidance systems to facilitate the on-going Genocide in Gaza.
 
There are five federal laws that are violated by unconditional and unconstitutional support of this illegal, genocidal war in Gaza:

1.  The Foreign Assistance Act,
2.  The Arms Export Control Act,
3.  The U.S. War Crimes Act,
4.  The Leahy Law protecting human rights, and 
5.  The Genocide Convention Implementation Ac
 
Under the Genocide Convention, to which the United States is a party and which was ratified as a treaty, we are bound to “prevent ” and “punish” any of the following acts committed with “intent to destroy, in whole or in part, a national, ethnical, racial or religious group, as such: 

a) Killing members of the group;
b) Causing serious bodily or mental harm to members of the group; 
c) Deliberately inflicting on the group conditions of life calculated to bring about its physical destruction in whole or in part;
d) Imposing measures intended to prevent births within the group;
e) Forcibly transferring children of the group to another group.”
 
Article III makes it a crime to be “complicit” in Genocide.  
 
No one can any longer deny that the world has been witnessing “genocide”. We watched in real time Israel’s bombing campaign, horrendous death and destruction inflicted on Palestinian people by that region’s most powerful (and nuclear armed) military and the world’s sixth largest air force. 

We witnessed decimation of Gaza’s unarmed civilian population, women, children, babies, burned alive, buried under rubble, starved to death and intentionally deprived of everything supporting life, including food, water, fuel, electricity, and medical supplies, while our government continues to supply billions in aid and military support to the genocidal, apartheid State of Israel.

United States repeatedly provides diplomatic cover at the United Nations, with our Security Council veto, of every effort brought forward by nations of conscience to hold Israel accountable. No one can deny our complicity with war crimes, crimes against humanity and Genocide.  And the genocide continues even after the latest so-called “peace plan” that returned the remaining “hostages” to Israel.
 
But no one holds accountable those who are enabling the genocide by voting to arm Israel, making and shipping the weapons, and those who are taking huge campaign contributions from the perpetrators of the genocide, whose pocketbooks and bank accounts are padded with the bribe money from the weapons manufacturers and surveillance tech corporations who supply, arm and enable the mass destruction of the people of Palestine. 
 
Why is no one being held accountable? 
 
One reason is the “Political Question’s Doctrine”. At least two important law suits have been filed in Northern California seeking to hold elected officials liable for deaths and physical/psychic injuries resulting from this on-going genocide and to enjoin the use of our tax dollars to fund the atrocities and crimes to which our elected officials are making us complicit.

The judges dismissed both cases, using the rational (excuse) that the judicial system is impotent to rule in questions involving “foreign policy”, that being the exclusive purview of the Executive Branch of government.
 
That doctrine must be challenged as it cannot withstand scrutiny under the U.S Constitution.  Article VI of the Constitution, (which all attorneys and judges are required to take an oath to uphold), says:
 
“. . . all Treaties made, or which shall be made, under the Authority of the United States, shall be the supreme Law of the Land, and the Judges in every State shall be bound thereby, any Thing in the Constitution or Laws of any State to the Contrary notwithstanding.”

Genocide Conventions were adopted by treaty and Judges are bound thereby. Judges must uphold the Constitution and take all necessary steps to prevent and punish the International Crime of Genocide.
 
This is crucial. If there is no accountability, injustice with impunity invites repetition. We see that unbridled conduct multiplying in Africa, in Venezuela—and now those who think they are above the Law are bringing the cruelty and lawlessness home. Nowhere is safe if we don’t stand up and stop it.
 
As Martin Luther King once said:  “Somehow this madness must cease.”
 
Here it is why it is so crucial that we stop this madness! 
What is occurring, injustice without accountability, is that genocide is being normalized. International Humanitarian Law, established by the nations of the world after World War II. agreeing that what happened under the Nazis regime “should never happen again”, is being shredded by failure to hold the Zionists (in collusion with the United States and other Western powers, notably the UK and Germany), accountable. And if Genocide is permitted with impunity in Israel, it multiplies and is repeated elsewhere—wherever strong nations with superior weaponry covet land and resources of weaker peoples. And that kind of gross inhumanity, as we now see multiplied around the globe, eventually comes home. 
 
And we are witnessing that now as this administration violates the Posse Comitatus Act by bringing into our cities military personnel for domestic law enforcement. And we see cruelty and heinous crimes being committed in our name both at home and abroad, with our tax dollars and watch the squandering of our resources for murderous destructive madness, instead of the betterment of humanity and the health of the planet.
 
If elected Attorney General of the State of California, I vow to uphold the Constitutional duty to prevent and punish Genocide and halt our complicity in it. It may require lawsuits against some of our State’s most powerful tech and weapons manufacturing corporations. 
 
If we don’t stand against Genocide we could witness the “Graveyard of International Law” as Raji Sourani suggested, and the law of the Jungle, MIGHT MAKES RIGHT, will reign on the planet, to the detriment of us all.
